Jury concludes that FBI violated the American With Disabilities Act when it refused to hire a diabetic as a Special Agent. – Kapche v. Holder, May 21, 2009.
David Cashdan was a member of the attorney team that recently secured a disability discrimination victory in the United States District Court for the District of Columbia for Jeff Kapche who has Diabetes I.. The FBI had refused to hire Mr. Kapche because he chose to manage his type 1 diabetes with insulin injections. Even though Mr. Kapche had an impeccable record of managing his diabetes without complications and an outstanding record of 15 years as a law enforcement officer with the Texas Sheriff’s Office and the San Antonio Police Department, the FBI required that Special Agents use insulin pumps and not injection therapy.
